RTI on Cyber Cell Mumbai by RTI activist Sapan Shrivastava for Insurance Scam.


Dear Sir,

 I Sapan Shrivastava respect Mumbai Police for his sacrifice and alertness to keep citizens safe. They are already overloaded to keep nation safe. Being RTI Activist I never intercepted in police functioning and never suspected their procedure . Due to my past bitter experience in fighting against white color corruption Mumbai Police is miss used by corrupt corporate to suppress largest scam of nation in Rs 15 Lac cr insurance sector.
I am a  Customer of a Insurance company ICICI Prudential Life . As a customer I have basic fundamental rights to question about investment details . As per supreme court guidelines financial companies must be transparent and white color . Supreme court also rules that issue raised in public interest not fall under defamation . If such thing happens then all the whistle blowers may be at prison or in court. Govt. also  provide protection to whistle blowers by various commitment at court. Earlier I was agent of IRDA  and was assigned to sell insurance product of ICICI Prudential Life. I was terminated illegally by company and ICICI Prudential tried to keep me away of public interest by sending legal notice 2 years back. They never approached court for defamation but in 2012 took short cut of IT act 66 A for defamation. As the  correspondence was done with all the stake holders of IRDA by email, because govt. promote paper less communication and email correspondence is speedy & cheap. As a customer I have basic rights to check the product details under Govt. of India initiative Jago Grahak Jago . Govt. insist us to take all details from company as a customer , because it is the rights of customer.
    I have asked for product approval certificate of IRDA to ICICI Prudential of the plan which I have purchased , but the company denied to show me. Later I filed police complaint at Thane Police commissioner but they denied to register FIR . But in similar case , Kashmir Police registered FIR against ICICI Prudential under various section including 420 by customer request.  Taking revenge ,ICICI Prudential  registered complaint against me (customer)  and in March 2013 registered FIR Under IT act 66A. Cyber Police also seized my hard disk , 2 cell phones,3 Sim card and data cable for asking product approval certificate. It seems that I have done crime  with the company by purchasing company product. Cyber cell also not provided  the copy of product approval certificate which was available in  the police record. If  company can display their awards in website then what is the issue to display the product approval certificate in their website. Normal tax payers buy policy to save tax and later being harassed by company. Information is required for PIL under Bombay High Court and for public awareness.



RTI questions:

1.       Date wise action taken by Police commissioner office for complaint against Mukund Pawar ( cyber Cell) for threatening  ( copy of documents).
2.       Details of guidelines to deal with police staff threatening and miss behavior complaint ( with Copy)
3.       Guidelines for seizing of electronic devices under IT act ( Kindly provide Soft copy or url link).
4.       Details of technology used by Cyber Cell to clone(copy) the electronic devices( hard Disk etc.) as per guidelines.
5.       List of electronic equipment available with name (model no. ) to do clone/copy with Mumbai cyber police as on 28 Feb 2013. ( with calibration certificate)
6.       After seizing devices from my house what type of various permission is required to keep the seized device under custody ( from Top officers/court).
7.       Time limit to keep the seized device and various extension required to extended time limit.(with copy)
8.       Name of the department where my devices are presently available for investigation.( With Name of the officer and address)
9.       Details of Total Persons( in No.) came to raid at  my house/office with their Name ,occupations, address  and educational qualification.
10.   Name of the officer(with Post) whose legal advise is taken before registering FIR with his qualification and post.(copy of advise letter)
11.   Information regarding , after or before registering FIR any Insurance Regulator and Development Authority (IRDA) representative was called for suggestion ( Yes or No) with name of Officer and date.
12.   IRDA has issued any letter against  Sapan Shrivastava  to Mumbai Police regarding defamation complaint (Yes or No).
13.   Information required about Officers working at Cyber Cell Mumbai  with their Name, Designation , qualification, Date of Posting in Cyber Cell , duties and name of training taken on which date .
14.   Information regarding number of complaint received at cyber cell Mumbai In  physical form and by  email. From April 2006 to March 2013 on yearly basis.  
15.   Action taken by cyber cell Mumbai (in no.s) on complaints on yearly basis from April 2006 to March 2013 on yearly basis.
16.   Total no. of FIR registered by Cyber cell Mumbai under IT act 66A  and by court order from April 2006 to March 2013 on yearly basis.
17.   Guidelines to get the details of IP address of the user from operator ( copy of guidelines).
18.   Have permission taken as per guidelines to get the details of sapan shrivastava from operator? (Copy of various permission)
19.   Various penalty details of cyber rime cell in case of offence and collection in Rs from April2006- March 2013 on yearly basis.
20.   Action taken  by cyber crime cell on various comments available on various website against ICICI Prudential lIfe .
21.   Details regarding , ICICI Prudential life provided copies of comments in other websites hurting its reputation to Cyber Crime cell till Feb 2013. ( if yes then Copy of action).
22.   As per Maharastra  Police record any Insurance company have registered FIR against any customer under IT act 66A . Provide the number of complaints with name of the company with police station name. April 2006 to March 2013 on yearly basis.( if no then copy of all district police commissioners letter).
23.   Information on ,The  ICICI Prudential Life complaint was shared with EOW or any other Department. If  yes then name of department , date of contact & officer name.
24.    What is the punishment under IPC to register false FIR .
