Mumbai: A writ petition has been filed for disciplinary action against Registrar Judicial of Bombay High Court at principle bench of Mumbai. The aggrieved petitioner is media reporter and regularly filing petitions at Bombay High Court. As per petitioner the Scrutiny committee for party in person is doing partial behaviour since 2016. As per party in person rule the scrutiny committee has to do interaction with every applicant. The main objective of rule is to comply OS and Appellate side rule by the party in person. The notification have "Competent" clause to grant permission to appear before court without any definition of "COMPETENT". The officers where using the word "Competent" to reject the application. The committee members where submitting one line reports to court that the applicant is not competent to assist the court without speaking order. Using the report few judges did not allow the applicants for submission. As per petitioner he is facing linguistic & other discrimination with violation of his fundamental rights since last 1 year.
The petitioner prayed that major disciplinary action against the respondents under Authority to institute proceedings as per Maharashtra Civil Services (Discipline and Appeal) Rules, 1979. As per petitioner there is violation of article 14 ,15 and 21(Law Of Equality). The matter will be listed soon with Honorable court.Respondents :
